Auction terms
These terms govern the use of BidMexico and participation in any auction published on the site.
1. Who operates the site
BidMexico is operated by the company that holds the domain. Its registered name, address and tax details are still to be entered in this document, and will be published before the first auction.
2. What BidMexico is and is not
BidMexico is an intermediation platform that runs property auctions on the seller’s behalf. It is not a notaría, not a financial institution and not a party to the sale. It never receives, holds or transfers the buyer’s money.
3. Registration and clearance to bid
Browsing is open to anyone. Bidding needs a verified account with current photo ID, acceptance of these terms, and the reservation deposit recorded under the strategy in force. BidMexico may suspend an account and void its bids.
4. What a bid is
An accepted bid is a firm, irrevocable offer at the stated amount. The highest bid at close, if it meets the reserve, obliges the buyer to sign the promesa de compraventa within the stated period.
5. Reserve
A lot may carry a reserve price, which is never published. The listing states only whether the reserve has been met. If it is not met at close, the seller may accept or decline the highest bid.
6. Close and automatic extension
Each lot closes at the stated time, measured by the server clock. A bid received inside the final window extends the close by the configured period, with no limit on the number of extensions.
7. Reservation deposit
The reservation deposit is recorded on winning and credited against the final price. The strategy in force, the amount, and the circumstances in which the deposit is forfeited are set out on the lot listing and in the promesa de compraventa.
8. Commission and costs
BidMexico’s commission is paid by the seller on the sale price. Closing costs (notario, ISAI transfer tax, Public Registry) are paid by the buyer and quoted by the notario before signing.
9. Documents and verification
No lot is published without a complete pack. Each document is verified by a notario or lawyer identified by name and date on the listing. BidMexico publishes that attribution and does not replace any review the buyer commissions independently.
10. Ejido land
Lots with ejido origin are flagged on the listing and require documented, verified regularisation before publication. Flagging a lot as ejido withdraws it from the schedule until that regularisation exists.
11. Closing before the notario
The sale completes before a notario público. A foreign buyer in the restricted zone needs a permit from the Ministry of Foreign Affairs and a bank fideicomiso. The usual period is 6 to 12 weeks.
12. Liability
BidMexico is answerable for the operation of the platform and for the accuracy of each verification attribution. It is not answerable for the physical condition of the property, nor for events after close that lie outside the platform.
13. Personal data
The handling of personal data is governed by the privacy notice, which forms part of these terms.
14. Changes
BidMexico may change these terms. The version that applies to an auction is the one the user accepted on being cleared to bid, recorded with its date.
15. Governing law and jurisdiction
These terms are governed by Mexican law. The parties submit to the competent courts of Quintana Roo, unless the law provides otherwise.
